Freedom of Information

The Freedom of Information Act was passed on 30th November 2000. It gives general right of access to all types of information held by public authorities. Full right of access commenced in January 2005 and replaced the Government's Code of Openness which had been in operation since 1994.

What does this mean to the NHS and its users?

  • Users will be able to find out more about the performance of the Trust
  • The Act created the office of the Information Commissioner
  • The Trust has a statutory duty to implement the Act
  • Patients continue to have a right to confidentiality
  • There are certain exemptions where information could be withheld
  • All requests for information must be responded to within 20 working days
  • There is a system of appeal if requests are not met within the specified time

    The Freedom of Information Act does not give individuals access to their personal information but they can, of course, request this under the Data Protection Act.

    The Trust wishes to be an open and welcoming organisation providing good information for our service users. Many of the Trust publications are available on this website and we have issued a Publication Scheme that tells you what information is available and how you can obtain it.
